 Swearing In of Fire Company Line Officers – Mayor Thomas Capaldi

 Councilwoman Gail Shast presented the Volunteer of the Year Award to long time resident Amelia Kressler.  Certificates from Senator Stephen Sweeney were also presented.  Ms. Kressler’s long time status as a County volunteer, her service to the Wenonah  and her overall impact on the borough and County were noted.  A proclamation was presented to her and the residents responded enthusiastically.

Lake Association Report – Ms. Harbold did not submit a written report but stated her great support for Ms. Braun and indicated she is a great neighbor and dedicated.  She also introduced Lake Association Board members present. Future donations to Wenonah Lake were discussed as well as their current functions (i.e. Garden Fair, their help with the Tea House, and the many other collaborations)  The upcoming Cabin Fever Party was mentioned.  Their $1000 donation to the Fire department was discussed as well as their $500 gift to the Environmental Commission. She also mentioned that she hoped to see Movie Nights at the lake.

Emergency Management – Dawn Carson was recognized for her efforts.

Pete Celano of the School Board discussed his satisfaction with the construction project, 30% of which was State funded. The addition will be 10,000 square feet.

MOTION TO OPEN TO THE PUBLIC:    BS/JN AIF

Resident Meredith Vieira, a 6th grader at the Wenonah Elementary School – read a letter about traffic issues at the school.  Cars are reportedly parked illegally and block the safety’s view, inhibiting their ability to safely cross children.  Children are being dropped off by their parents and jaywalk, and people are driving erratically around parked cars, etc.

The Mayor commented on the many efforts made to address the traffic problems at the school, including newsletters, Chief speaking at the school, meetings, painting the curbs yellow, etc.

Police Chief Glenn Scheetz, resident Mrs. Barbara Vieira, Ms. Hoffman, Ms. Braun, and a member of the Home & School Association will be assigned to a committee to investigate these problems.  Mrs. Vieira complained that high profile people in the Borough are offenders, as well as members of the Home & School, residents, school board, etc.  Avalon has high profile crossing areas.  The law requires parking 50 feet from the stop sign. Our yellow curbs do not extend that far. People need to carpool.  Children are at risk.  Officers double park to speak to people in cars.  They add to the problem.  Barricades are in some areas in Pitman and other towns to control traffic.  She brought samples of many control methods. She feels there should be four crosswalks in the area of the school. She encouraged the committee not to let this go until the summer.  An answer must be found quickly.  A Sgt. in Avalon helped her with many of these issues and suggested a pop up sign.

Gail suggested that Meredith herself be added to the group.  The Mayor agreed.

Mrs.Vieira also suggested Share The Road and Highway Safety sites for information or grants.

Paul Harwood – an 8th grade Boy Scout, made an offer to paint lines or a message in the street (crosswalk – Go Slow, etc) He also suggested that some adults work with the Scouts on the Traffic Safety Merit Badge.

Various comments re: possibility of making the street one way (permanent or temporary).  

Paul also suggested adult safeties or bright clothing.

Brandon Barney – A Boy Scout, indicated that the school may need more safeties to make additional reporting of jay walkers and unsafe behavior possible.

 Mr. Navins – made comments on Lizzy property and how that would possibly affect the interlocal figures.

 Ms. Hoffman asked about the jetter she believed was cut from the budget and expressed her concern about it.  It was explained that the jetter was never in the 2005 budget but was on a list of items for budget consideration over the next couple of years.  Public Works never expected to be able to acquire the jetter when there was a sizeable expenditure for a new dump truck already to improve leaf pickup in for 2005 and money for the new Public Works building. Mayor Capaldi reminded everyone that all Council members were present during the budget meetings and agreed on the final projects and purchases as presented to the CFO, Robert Scharle’, at the last subcommittee meeting. No objections were made at that time.

PB&G

 The Public Works Building was still being worked on and due to ongoing difficulties, Ms. Braun stated they were considered using a residential building, but for commercial purposes.  No one will commit to the build at this time.  We may have to think about a stick design.

 

Legal & Ordinance

 Mr. Navins reported that our ordinances are now online.  The Clerk announced that everyone will get the new website address in the newsletter.  This was part of the ongoing project she has been working on to provide faster and more complete in-house and resident access to ordinances.

PB Update – Wenonah Meadows.  Preliminary approval was awarded with variances and waivers.  A sign that exceeds the land use requirements and sidewalk exceptions were given waivers….Also some waivers for front fences. Water and sewer issues are still a concern.

 The worst case scenario presented was that the Borough provide sewer for the development plus the other residents on Woodbury-Glassboro Rd.

 COAH strategy may have worked. Mr. Duffield reported that Judge Rafferty allowed a new Master, resident Chuck Newcomb will take on that role.  That should speed up our program.

 Discussion of new requirement to have a fire extinguisher/co detector in every home.

 Lisa and Jim met with members of the pool board to try to informally discuss Mr. & Mrs. Mantini’s possible use of North Princeton as egress.  The pool board members were favorable to the concept and any further action will take place between the Mantinis and the Board.

Human Services – Everything is good with traffic issues at the school.  Less people seem to be hanging at the school which is helping the situation.

Ms. Hoffman also announced that Home Depot donated a $25 gift card for her fundraising project. She also mentioned seeing a Summer Camp program brochure from GCC which has a very strong 11-14 activity level for teens.

Sarah Harbold – Mentioned that she was approached about revitalizing the volleyball program. The Clerk mentioned that someone already had been in to see her about weekly volleyball at the lake and it was being put together by a resident.

Ms. Hoffman presented the Street Vacation Sub Committee Recommendation for the requested vacation referenced in Ordinance 05-9. This request was made by resident Todd Braun of South Princeton Avenue through a letter and personal request at a meeting. Ms. Hoffman reported no utilities, a fence and block wall prevents it as being used as a trailhead entrance, and referenced letters from the Borough Engineer, Planning Board (tie vote), Environmental Commission (tied), police (indicated no detriment to the provision of their services) & fire (indicated no detriment to the provision of their services). The Brauns offered to pay all legal fees relating to the vacation. She recommended vacating the ground 50% to the homeowners on each side. Mr. Duffield explained that that is the way the law mandates it done. Ms. Hoffman went on to explain that no other tax liability is incurred by vacating the ground.  She wanted to let everyone know that they were careful to consider this request as they would for any other resident. Mrs. Hoffman did note that Mr. Schnarr was opposed to the vacation of rights to that area as he feels the ground should be retained as conservation area access in the future.

 Motion to Approve Ordinance #O-05-9 “Land Vacation” BH/JN

 Discussion – Ms. Shast was concerned about whether a precedent was set by vacating.  Mr. Duffield does not necessarily feel that a legal precedent was being set.  He stated that he hoped the request was investigated so as to not affect access to the conservation area. In the future, we have to look at the specific stub end to determine whether it would have a particular effect on the Borough.  PB vote was 5-3. It was an informal vote.

 Ms. Harbold commented that it was her understanding that there are not too many stub ends in town to be affected.

 Ms. Braun – There are some that have utilities, etc. that would automatically remove those stub ends from consideration to be vacated.

Update on KEI Engineers and Greg Fusco – KEI has pulled the file on the Maple Street dam work and road repair. They inspected the site where we are complaining of the failing roadway & they will meet with us prior to May 31.

 Mr. Lombardo’s letter to the Council which complained about the excessive speeding.  Chief Scheetz updated Council on the results of the electronic speed monitoring since the speed humps were installed. Equipment was set up in front of the Lombardo home. 99.2% were under 34 mph. 97% were within 25 mph. It was noted that sometimes loud engines will create the illusion of speed through sound.

 Ms. Braun reported a request from a resident of Jefferson who wants speed humps.

 Ms. Harbold stated her concerns about the lake. She is happy about the improvements but she did not know what was happening about the sod.  She also wanted to ask about an adult presence at the lake.  She stated her concern is actually a concern of many residents.  She wants an individual who is 21. She wants to make sure little things don’t slide.

 The Mayor indicated that the matter was referred to the lake committee after Ms. Harbold’s last series of complaints. The Administrator informed the Mayor that the committee decided to proceed with the staff as is after reviewing the surveys, and complaints of which there were one from an out of town member who wanted equipment open later and those from Ms. Harbold.

 There was a brief discussion of mail issues.

They have a septic system and want to know if they can get on the public sewer system. The current line stops a short distance from their home on Mantua Avenue and because of the grade and location of her home, a pump is needed. 

 LB asked what the procedure would be for the residents to follow in making this request.  It was determined that they speak to the County first because the location involved is a county roadway and right-of-ways.

 Upon the Clerk notifying Council of a tie, Mayor Capaldi  read a statement (attach the statement) prior to his voting no for the ordinance.

 Motion to Open to the Public – BC/JN

 Resident Todd Braun of South Princeton Avenue – Thanked everyone for their time, but was upset that some see it as a sweetheart deal.  He stated that his wife works very hard for this town.  It took one year before an answer was given by council or Councilman Schnarr regarding his request. North Garfield was vacated by the Borough to 7 property owners.  The precedent was already set.  He stated that it is a shame that his wife working on council is working against him.  He feels that he is not being treated fairly and justly.

 Mayor Capaldi does not consider the family being treated unjustly and he explained his position again, including his concerns of perception and possible future use.

 Mr. Braun felt that Councilman Schnarr should abstain as he already voted on the Environmental Commission.  It was explained by Mayor Capaldi that that vote was informal.

 Ms. Harbold of South Princeton Avenue thought that it was a sweetheart deal against it.  She indicated that she knew that the Mayor asked the public.  Ms. Harbold stated that there is no access for the public because there is a cement wall and she feels that there would be an improvement to the property with no cost to the Borough.

 Mr. Braun again stated that he was upset regarding this matter.

 Mr. Schnarr spoke about the original intent of the committee and what they were charged with.  He reported that the committee never communicated with him and he was part of the committee.  He took offense to how Ms. Hoffman handled the committee.  She explained that the sensitive nature of the request was considered and she stated that Mr Schnarr was contacted.

 Mr. Braun wanted it on record that he thinks the council decision is wrong and he wants to formally request that the property be improved.  Ms. Harbold agreed. Mr. Braun feels that personal feelings were not kept separate of the request.

 In response to Mr. Braun’s request for improvements, Borough Engineer Dave Kreck stated that he does not recommend the Borough improving the street because it is against DEP protocol and he feels improving it for 2 residents does not serve the public. In regards to vacating the rights to the property (Ordinance 05-9) Mr. Kreck asked if any suggestions he makes for improvements could be enforced if the property is transferred to private homeowners. The Borough Solicitor, Mr. Duffield, said no. 

 Mr. Braun explained that he felt refusing his request for the property put the burden back on the taxpayer. The Mayor explained that he also lives on a stub end street.  Ms. Harbold indicated that it is paved. The Mayor reminded everyone that the homeowners paid to pave that street.

 Mr. Schnarr reported a concern with a Linden Avenue property – A soon to be resident is starting is to build a home. There is concerned that if he proceeds with the construction and has no formal agreement for sewer, he may qualify for a hardship variance. Mr. Navins, Mr. Duffield, and Mr Kreck spoke to Mr. Bucci, the lot owner.  Mr. Duffield suggested that he hire an engineer. He referred to a Marion Avenue situation where someone built the house without proper lot configurations and then adjustments had to be made by the Borough and the Planning Board. The Building Inspector should catch any situation. Mr. Navins asked what can be done to ensure that Mr. Bucci has a sewer/water plan. Mr. Duffield explained that that is a matter for the Building Inspector.

 The Clerk discussed the Zoning Inspector’s unwillingness to issue a permit while the two lots have not yet been combined into a single conforming lot.

 Discussion of current status of two lots and at what stage they need to be changed to one.  Brian will call John Leech, the Zoning Inspector.

 Open to the Public: BS/BC –

 Debbie Ennis, a resident of Marion Avenue. The Zimmer house is a mess and she was hoping that a maintenance ordinance would be in place by now as she was told last year that the ordinance did not yet exist. Mr. Navins stated the current ordinance states about untamed growth and condition of the house.  Exits and entrances must be clear and one entrance is taped off at the Zimmer property.  Mrs. Zimmer died and her adult son lives there.  Mrs. Ennis wants to know how far she should go. Concerned about the many mosquitoes. The Clerk suggested the Board of Health & Mosquito Commission.  She informed Mrs. Ennis that the Borough has joined county Board of Health services since she was last here.

 Mrs. Ennis also asked if she can get yellow paint on her curbs to leave her proper turning radius because the patients/visitors from Wenonah Medical constantly block her driveway. She feels she is acquiring lots of trash from the heavy parking.  She stated that the Smith family with the special needs child has some yellow curb beside the driveway so the bus can turn.  The Police Chief explained that yellow curb without an ordinance cannot be enforced, but he will speak with the streets department to see if some paint can be put there as an unofficial deterrent.

 COMMITTEE REPORTS

 Public Buildings & Grounds – Ms. Braun reported that she did find a commercial builder for PW site. The next step is to meet with Bldg. Inspector and Dave Kreck.  The price is $63,000 but she thinks it can be cut a little.  Drop fees, etc. bring it close to $70,000. She reported that due to time constraints she wants to get everything together and out to bid by the end of June, early July. PW would have to be relocated.  She suggested housing them in the old tax office. She estimated being finished by September.  We need to demolish the existing building, but a new office can be dropped into place quickly.  Paving at the end of 2005-06.  Mayor/Mr. Schnarr – commented that city sewer is across the street. Plans have to be stamped by an architect before we can go out to bid.

 Planning Board/Legal & Ordinance – PB had some resolutions approved.  Lizzy property – everyone is still waiting to see what is happening with sewer and water.  Wenonah Service Center is never to have an unregistered vehicle on the property.  Another major subdivision application is coming up later. A public hearing is coming up for COAH 3rd round numbers.

 New web site for ordinances is very accessible and easy to use.  If the public needs any information, this is great.

 Mr. Navins reported that he had received a copy of a letter about blatant censorship in the newsletter.  He stated it was inappropriate and had to stop. The Mayor indicated that the matter had already been referred to the personnel committee for investigation. Mr. Navins stated that “he knows his comments will piss people off but he doesn’t care”.

 Public Works – There was discussion of the street sweeper issue.  Regular sweeping must take place in order to meet stormwater prevention plans. There was discussion of availability of the sweeper.  Clerk mentioned that the sweeper was a private trade she made with Deptford and is not guaranteed to continue as Joe Picardi, the Town Manager, is whom she deals with and he is retiring.

 Discussion of drainage issues.

 Deptford sewer discussions are being postponed until after the Primary.

 Public Service from court assignments – 2 boys are expected to be issued community service for an ATV on the conservation area.

 Mr. Navins and Mr. Schanrr drove around looking at various paving issues including North Marion and Buttonwood.

Fire Report

Chief was awarded the Police Chief award by the GC Chief’s Association.

Ms. Capelli met with Chief Sole, regarding his request for a new fire truck.  She plans of meeting with PS committee and get more information on this.  Can there be a June work session even though Council is technically on the summer reduced meeting schedule? A recap was provided from Drew.  He referred to his October letter that he feels was ignored by the 2004 Public Safety Chair (Ms. Mayer).  The letter outlines his recommendation. He states the letter was never acknowledged until he met with John Colman in 2005.  2 weeks after he gave detailed information to John Colman, Mr. Colman resigned.  The Fire Chief indicated that he is ready to go on this.  He wants to come to a committee meeting.  It will take a year to design/build a new truck. He wants to get rid of one of the pumpers and sell the rescue truck. He did not form a committee within the Fire Department. Representatives of the Fire Company met with a vendor and went to the fireman’s expo in Harrisburg, PA.  Every vendor was at this show. By current standards he represented that the truck must be replaced.  This is the Fire Department’s wish, not the Chief’s. The Mayor explained how we try to fit this into the budget. Ms. Braun indicated her concern with postponing the ordering of the equipment if payments can be worked out. The Fire Chief explained there are some programs where payments can be delayed.  Last time they bought fire apparatus was 1992.  He stated that he didn’t want to hear that they just got an ambulance, because it is not the same.  It was agreed that the matter would be investigated further.
